These Terms govern your use of the Pay4Feedback platform. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Parties & Scope
These Terms apply between you (the “Customer”) and Dmytro Rybka, Im Hoffeld 31/1, 74427 Fichtenberg, Germany (the “Provider”). The Service is offered exclusively to entrepreneurs (Unternehmer) within the meaning of § 14 BGB; it is not offered to consumers (§ 13 BGB).
2. Non-Custodial Escrow Disclaimers
Pay4Feedback is not a payment institution or money-services business. The Service is a non-custodial orchestrator: the Customer’s campaign budget is collected by Stripe Payments Europe, Ltd. (a regulated EU payment service provider) and disbursed to end-users via Tremendous, LLC (a regulated US payout platform). Funds transit briefly through our Stripe account and are held in Tremendous’s pooled balance only for as long as necessary to fulfil the transaction.
- We do not hold Customer or end-user funds on our own balance sheet.
- We are not a licensed escrow agent under § 34c GewO or BaFin regulation.
- We do not earn interest or yield on transiting funds.
- Reward payouts are executed by Tremendous on request; Pay4Feedback is not responsible for the delivery of gift cards, PayPal transfers, or other instruments chosen by the recipient.
- In the unlikely event of a Tremendous outage, we will refund the Customer the unspent budget portion minus platform fees accrued on already-approved feedback.
By funding a campaign, you warrant that the budget is paid from legitimate business funds and does not violate any applicable AML, tax, or sanctions laws.
3. Subscriptions & Platform Fee
We offer three plans, each with a different platform fee applied to campaign rewards:
- Starter — €0/month, 25% platform fee on rewards
- Growth — €49/month, 10% platform fee on rewards
- Enterprise — €299/month, 5% platform fee on rewards
All prices are net of VAT. Paid plans are billed monthly in advance via Stripe and renew automatically until cancelled. No refunds for partial months.
4. Acceptable Use
You must not use the Service to collect sensitive personal data without a separate legal basis, to manipulate quality scoring, to submit fraudulent responses, or to reverse-engineer the platform.
5. Warranties & Liability
The Service is provided “as is”. We are liable without limitation for intentional misconduct or gross negligence, and for damages under the Product Liability Act. For ordinary negligence, aggregate liability is capped at the fees paid in the twelve (12) months preceding the event giving rise to the claim.
6. Data Processing
Personal data is processed in accordance with our Privacy Policy. Where you upload end-user data to your tenant, you are the controller and we act as processor. See our full Data Processing Agreement (Art. 28 GDPR), or request a counter-signed copy at support@pay4feedback.com.
7. Termination
Either party may terminate for convenience at the end of the current billing period. We may terminate immediately for material breach or misuse. Upon termination you may export your data via CSV.
8. Governing Law & Venue
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN CISG. The exclusive place of jurisdiction is Stuttgart, Germany, provided the Customer is a merchant (Kaufmann), legal entity under public law, or special fund under public law.
9. Changes
Material changes are announced by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
